If you continue to browse and use this website, and enrol on our courses, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Create PT’s relationship with you. The term “us” or “we” or “our” refers to the proprietor of Create PT and this website. The use of this website and enrolment on any of our courses is subject to the following terms of use.
The content of the pages of this website is for your general information and use. It is subject to change without notice. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. We do not take any responsibility for consequences of anyone acting as a result of the use of this website or of the enrolment of any of our courses.
Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements. Your use of this website and any dispute arising out of such use of the website is subject to the laws of England, Scotland, and Wales.
By completing checkout you confirm that you have read, understood, and agree to be bound by the following terms.
- Enrolment and Formation of Contract
- 1.1 Enrolment is made via our online enrolment/checkout process or, for phone sales, via the enrolment recorded by our sales agent and confirmed to you in writing. Completing checkout and submitting payment contracts you to pay for the course(s) as detailed in the Schedule.
- 1.2 Your enrolment is accepted upon payment in full made directly to Create PT, or upon a direct debit or finance arrangement being agreed with Create PT (including, where applicable, payment of a deposit).
- 1.3 The secure payment link provided to you must only be used in relation to purchasing a course or paying a deposit for a course.
- Payment Obligation
- 2.1 You agree to pay the total course fee set out in the Schedule in full, in accordance with the payment plan (if any) set out in the Schedule.
- 2.2 Where payment is made by direct debit or through a finance provider, you authorise those payments to be collected on the dates set out in the Schedule and agree not to cancel the direct debit mandate without first settling any outstanding balance.
- 2.3 The course fee set out in the Schedule is the total amount due for the course as described. Optional extras, extension fees, and rebooking charges are not included in the Schedule fee unless expressly stated.
- 2.4 Create PT reserves the right to withdraw learners who do not keep up to date with payments.
- Missed and Failed Payments
- 3.1 If a scheduled payment fails or is not received by its due date, we will notify you and may re-attempt collection (we may apply to your bank for a direct debit payment more than once within a calendar month). If any payment remains unpaid for more than 30 days from its due date, the full outstanding course fee becomes immediately due and payable in full.
- 3.2 We reserve the right to instruct a debt collection agency, refer the matter to our solicitors, or commence County Court proceedings to recover any outstanding balance. If course fees are not paid, we may restrict access to learning materials and prevent you from completing your course.
- 3.3 Interest on overdue balances. We reserve the right to charge interest on any overdue balance at a rate of 8% per annum above the Bank of England base rate, accruing daily from the date payment was due until payment in full. We also reserve the right to apply a reasonable administration fee to reflect the cost of pursuing overdue accounts. We will notify you before applying any administration fee.
- Certification
- 4.1 You will not receive your course certificate until the full course fee has been paid. If you pass your course before completing your payment plan and find employment, you may either amend your payment plan or request written confirmation to your employer that you have passed and will receive your certificate upon completion of payment.
- 4.2 Certification is issued upon successful completion of all required elements and external verification by the awarding organisation. Delays in certification may occur due to external verification schedules, which are outside our control.
- Course Completion, Extensions and Withdrawal
- 5.1 You have 12 months from the course start date set out in the Schedule to complete your course, unless otherwise agreed in writing. Work submitted after this period will no longer be assessed.
- 5.2 If you have not completed your course within 12 months, you may continue at the prevailing extension rate, currently £100 per calendar month.
- 5.3 After 12 months you may withdraw if you do not wish to continue. Re-enrolment after withdrawal will require payment for the whole course again. If you do not notify us of your decision within four weeks of your course end date, your contract will be terminated.
- Cancellation and Refunds
- 6.1 Self-paced (fully online) courses: you are entitled to a 30-day money-back guarantee from the date of purchase, during which we will refund you in full if you are not satisfied with your purchase.
- 6.2 Cohort-based and blended courses with in-person elements: you are entitled to a 30-day cancellation period from the date of purchase, unless you attend an in-person workshop or assessment day within that period, in which case your cancellation period ends at the point you attend that in-person day.
- 6.3 After the applicable cancellation period has ended, you are fully liable for the total course fee set out in the Schedule and will not be entitled to any refund or concession.
- 6.4 Cast Iron Guarantee. Separately from the cancellation rights above, we offer a “Cast Iron Guarantee”: a money-back guarantee available to learners who complete all elements of their course and remain dissatisfied. This guarantee is subject to separate terms and conditions, which set out the eligibility criteria and the conditions that apply. Those separate terms are incorporated into this Agreement by reference and are available at creatept.com/cast-iron-guarantee or on request. The full details of the guarantee are not reproduced here.
- Attendance, Workshops and Rebooking
- 7.1 For cohort-based courses, attendance at all scheduled practical workshops is compulsory to meet course requirements. Missed sessions may delay assessment.
- 7.2 If you fail to attend a training day or assessment day, you will be liable for a rebooking fee of £25, unless you cancel at least 24 hours prior to attendance.
- 7.3 Workshops and live assessments may be available at an additional charge where not included in your course.
- Prerequisites
- 8.1 Applications for courses that require a pre-requisite qualification must be accompanied by proof of the required qualification. Create PT may withdraw applications from learners it deems unfit to start or continue a course.
- Assessment and Results
- 9.1 It is your responsibility to complete all required course content and to spend sufficient time preparing. Whether you pass is at the sole discretion of the Create PT assessor.
- 9.2 Exams marked by the centre will have results issued within 7 working days of the assessments being received at HQ (not from the date you attend). Assessments marked by the governing body can take up to 14 working days.
- Conduct
- 10.1 You agree to behave respectfully towards all Create PT staff, assessors, and fellow learners in all interactions, including online communication and in-person workshops.
- 10.2 Create PT will not tolerate any form of abuse towards its staff or tutors. Any learner whose behaviour or conduct we deem inappropriate may be immediately withdrawn from their course and legal action taken if necessary. This also applies to the conduct of a learner’s authorised representatives (which may include a parent, guardian, partner, spouse, or friend). Withdrawal under this clause does not entitle you to a refund.
- 10.3 Create PT reserves the right to refuse enrolments, or suggest alternative arrangements, where it believes attendance would not be in the best interest of the company, other participants, or the individual concerned.
- Learning Platform Access
- 11.1 Your login credentials for the learning platform are for your personal use only and must not be shared. Create PT reserves the right to suspend access if misuse is identified, or where your account is in arrears, until the outstanding balance is resolved.
- Intellectual Property and Website Use
- 12.1 This website and its materials — including design, layout, appearance, and graphics — are owned by or licensed to us. Reproduction is prohibited other than in accordance with our copyright notice. Unauthorised use may give rise to a claim for damages and/or be a criminal offence.
- 12.2 Website content is provided for general information and may change without notice. We exclude liability, to the fullest extent permitted by law, for any inaccuracies or errors in the information and materials on the website. The website may contain links to other sites for convenience; we are not responsible for their content.
- Limitation of Liability
- 13.1 Your use of any information or materials on the website is at your own risk. It is your responsibility to ensure that any products, services, or information meet your requirements.
- 13.2 Create PT will not be liable for any indirect, consequential, or incidental loss or damage arising from the use of course materials, online systems, or attendance at in-person workshops.
- Data and Communications
- 14.1 By agreeing to these terms you consent to Create PT contacting you by email, SMS, or phone regarding course updates, reminders, and relevant opportunities. Your data will be handled in accordance with our Privacy Policy, available at creatept.com/privacy.
- 14.2 You also consent to us sharing your details with third parties for the purpose of introducing you to potential employment opportunities for which you may be eligible.
- Governing Law
- 15.1 This Agreement is governed by the laws of England and Wales. Any dispute arising from it shall be subject to the exclusive jurisdiction of the courts of England and Wales.
- Entire Agreement
- 16.1 This Agreement — comprising the Schedule, these Terms and Conditions, any applicable course-specific terms, and any separate terms expressly incorporated by reference (including the Cast Iron Guarantee terms) — constitutes the entire agreement between you and Create PT relating to your enrolment and supersedes any prior terms, representations, or understandings. The terms you agree to at checkout and the terms you sign in this Agreement are one and the same.
APPENDIX 1 — COURSE-SPECIFIC TERMS
Personal Training
- A1.1 Upon successful completion you will receive a certificate from our awarding organisation, Focus Awards.
- A1.2 This is a fully online course; all tasks and assessments are carried out within the learning platform or via video. Workshops and live assessments may be available at an additional charge.
- A1.3 You are entitled to support from our assessing team. Tutor support is available through the learning platform, via email, and via video at no extra charge. All assessment feedback is provided via the learning platform, email, and video.
Pilates
- A2.1 Upon successful completion you will receive a certificate from our awarding organisation, Focus Awards.
- A2.2 Pilates is delivered in a blended format, combining online e-learning with in-person workshop and assessment days.
- A2.3 As a course with in-person elements, the 30-day cancellation period in clause 6.2 applies: your right to cancel ends if you attend an in-person workshop or assessment day within that 30-day period.
- A2.4 Attendance at all scheduled in-person workshop and assessment days is compulsory to meet the course requirements. Missed sessions may incur a rebooking fee (see clause 7.2) or may delay assessment.
